Over the past year or so, we have seen an uptick in the number of clients asking us about compliance with the Telephone Consumer Protection Act. While it may seem like a straightforward statute, compliance with the TCPA can be tricky and depends on a variety of factors including the type of call placed, the type of equipment used, and the type of consent obtained. Importantly, many of our clients may be compliant with the TCPA, but may have forgotten about comparable state laws that, often times, have more stringent requirements. Failure to comply with the TCPA (and comparable state laws) can result in expensive lawsuits or enforcement actions. The goal of this presentation is to arm you with enough information to help you and your clients issue spot potential TCPA pitfalls and help your clients find the resources they’ll need to become, and stay, TCPA compliant.
