Cathy McMorris Rodgers (R-WA) released a discussion draft of the latest federal privacy proposal, known as American Privacy Rights Act (“APRA” or the “Act”). On September 14, 2023, the California legislature passed S.B. 362 (“Act”), a bill that would impose new requirements on data brokers and grant residents new rights designed to facilitate control over their personal data. S.B. 362 is now awaiting signature by California Governor Gavin Newsom. The Act aims to close a loophole in the California Consumer Privacy Act (“CCPA”) that allows consumers to request that data brokers delete personal information obtained directly from the consumer, but does not require data brokers to delete personal information obtained from other sources.

The Administration also met with the CEOs of Alphabet, Anthropic, Microsoft and OpenAI as part of the Administration’s broader, ongoing effort to engage with advocates, companies, researchers, civil right organizations, not-for-profit organizations, communities, international partners, and others on critical AI issues. On July 1, 2020, the Dubai International Financial Centre (“DIFC”) Data Protection Law No. 5 of 2020 came into effect (“New DP Law”). Due to the current pandemic, a three-month grace period, running until October 1, 2020, has been provided for companies to comply. The New DP Law replaces DIFC Law No. 1 of 2007. The release of the New DP Law is, in part, an effort to ensure that the DIFC, a financial hub for the Middle East, Africa and South Asia, meets the standard of data protection required to receive an “adequacy” finding from the European Commission and the United Kingdom, meaning that companies may transfer EU/UK personal data to the DIFC without putting in place a transfer mechanism (such as Standard Contractual Clauses).

The International Trade Administration at the U.S. Department of Commerce recently announced that NCC Group has been approved as a U.S. Accountability Agent under the APEC Cross-Border Privacy Rules (“CBPR”) system. NCC Group joins TrustArc and Schellman as the third U.S. Accountability Agent under the CBPR and the sixth Accountability Agent approved under the system overall. NCC Group will now be able to independently assess and certify the compliance of U.S. companies under the APEC CBPR system and under the APEC Privacy Recognition for Processors (“PRP”), a corollary system to the CBPR specifically for processors.

On January 27, 2020, CISCO released its 2020 Data Privacy Benchmark Study entitled “From Privacy to Profit: Achieving Positive Returns on Privacy Investments” (the “Study”). The Study explores the return on investing in privacy compliance for organizations, examines how such return correlates with an organization’s accountability level and details the value of privacy certifications in the buying process. To measure organizations’ accountability level, CISCO used the CIPL Accountability Wheel, a privacy accountability framework developed by the Centre for Information Policy Leadership. On July 25, 2019, the French Data Protection Authority (the “CNIL”) published new template records of data processing activities pursuant to Article 30 of the EU General Data Protection Regulation (“GDPR”). This provision requires organizations subject to the GDPR to maintain internal records of data processing activities. The CNIL recalled that such records are a key accountability tool under the GDPR for identifying, understanding and controlling data processing activities.
