EPA’s ‘Waters of the United States’ Rule: Substance and Significance

On May 27, 2015, the Environmental Protection Agency released the final Waters of the United States rule. Response to the WOTUS rule has been immediate, vocal, and varied across the political spectrum. Understanding the scope, vulnerabilities, and likely implementation of the WOTUS rule is central for practitioners, so, on June 8, the Environmental Law Institute convened a panel of experts to explore this vitally important new rule. Deidre Duncan, who was a member of the five-member panel, provided her thoughts from industry and environmental perspectives.
