Hunton Andrews Kurth LLP’s trial team recently secured a favorable outcome for Bobcat Endoscopy LLC (formerly, LumenR LLC) against a former consultant, Mr. Oleg Shikhman.

Following a successful asset purchase transaction between LumenR LLC and Boston Scientific Corporation, Mr. Shikhman, years after his involvement with the company, attempted to challenge the meaning of a 2009 consulting contract and made numerous allegations against the company and its founder, Dr. Gregory Piskun.

Our litigation team secured pre-trial dismissal of most of the counts asserted by Mr. Shikhman. Following a trial on the remaining counts, Bobcat Endoscopy and Dr. Piskun received a favorable verdict. In particular, the court found no liability against Dr. Piskun and dismissed all counts against him personally. The court also rejected Mr. Shikhman's attempt to obtain a seven-figure windfall and, instead, enforced the 2009 consulting agreement with Mr. Oleg Shikhman as written.
