Self-directing an IRA to invest in certain unique assets (e.g., an LLC) can create a powerful return. But there are rules that must be followed in order to be successful under the regulatory regime. The purpose of this discussion is to lay out the framework of the rules governing self-directed IRAs, including:

  • Design thoughts when navigating the prohibited transaction rules
  • The possible use of a tenants in common structure to avoid becoming a “disqualified person"
  • Possible valuation issues at the IRA custodian level
  • Design ideas to avoid unrelated business taxable income
  • And more
